250 Apartment Lawsuit Reaches Court of Appeal

    In August of 2015 Central citizens Dave Freneaux, Mike Mannino, and Mike Stephens challenged the legality of the City's approval of a high-density 250-apartment complex across Joor Road from Walmart.  In October of 2015 District Court Judge Fields ruled that Central's City Council had the discretion to allow 250 apartments to be built when the city's ordinances allowed only 42 apartments.  That decision has been appealed. 
    On January 9th the First Circuit Court of Appeal will hear oral arguments in the citizens' appeal of the lower court's decision. The three-judge panel will consist of Judges Welch, Crain, and Holdridge.
    Both sides submitted written briefs about six months ago. At the January 9th hearing each side will be given 15 minutes to argue key points of the case and answer questions that the judges ask. A decision will follow in as little as weeks or as much as months later.
