Court records indicate that on 5/27/2010 CH2MHill’s counsel filed an opposition to Community Press’ Writ of Mandamus and Declaratory Judgment, a Motion for Summary Judgment (a motion which can have the effect of dismissing some or all of the claims) and Exceptions of Improper Use of Summary Proceedings, No Right of Action, Lack of Standing and Failure to State a Justifiable Controversy (exceptions can have the effect of dismissing some or all of the claims). Additionally, CH2MHill’s counsel filed a Motion to Expedite and Consolidate the hearings on the motion for summary judgment and petition for writ of mandamus. The Court is scheduled to hear the exceptions and motions on July 12th and to conduct the trial on July 23rd, if necessary.
